If you missed the first event, CFPB Director Rich Cordray talked about CFPB’s inquiry into overdraft practices. Here are some of the things the Bureau is working on when it comes to overdraft protection. EXCERPT BELOW IS TAKEN FROM THE CFPB’S WEBSITE:

  • We’re researching how overdrafts affect you. We launched an inquiry through a data request that is being sent to a number of banks and a Notice and Request for Information to gain insight into overdraft practices.
  • We want you to understand what actions you can take now to protect yourself from overdraft fees. Do you know your overdraft status? Read our Consumer Advisory that explains how you can learn whether or not you have opted in to debit overdraft fees on ATM and point-of-sale transactions. Go to our Twitter and Facebook accounts to tell us your debit overdraft status.
  • We’re working to make it easier for you to understand the costs and risks of overdraft programs. Our model overdraft “penalty fee box” is a thought-starter for a disclosure that would appear on your checking account statement and online banking landing page. It would highlight the amount overdrawn and total overdraft fees charged, so you so can clearly see how much overdrafts are costing you. Tell us what you think.

CFSA’s Board Chair sets the record straight on “unlicensed, offshore” lenders

The following comments can be attributed to D. Lynn DeVault, Board Chair of the Community Financial Services Association of America (CFSA). This release was put out on the wire during today’s hearing in Birmingham, AL:

“Today’s Reuters story about the payday lending industry is very misleading and sets up a conflict with related industries that simply does not exist. Its emphasis does not reflect the tone and content of the several interviews the reporter conducted with three different industry spokespersons.

“Interviews initiated by the reporter focused on basic questions about the product, the history of the industry and the consequences of restrictions. One of the conseqences mentioned by spokespersons was the increased concerns by state officials of “unlicensed, offshore” lenders. The story does not relect this emphasis and instead accuses us of criticizing online lenders.

“To be clear, CFSA believes that online lending is an important and needed option in the small loan market and many of our member companies are engaged in state regulated online lending. It is an innovative and valuable service for millions of consumers.

“We will continue to point out the differences between highly regulated lenders and those that operate offshore and illegally. We hope reporters will learn the distinctions as well.”

Congresswoman Sewell says her constituents need access to short-term credit

Today, Rep. Terri A. Sewell (D-AL) will introduce Director Richard Corday at today’s CFPB hearing in Birmingham. Sewell released a statement, and in it said the following about access to short-term credit.

Here’s an excerpt from her statement released on the wire early this morning:

“Given these challenging economic times, many of my constituents across the 7th Congressional District of Alabama and families across this country rely upon the payday loan industry to satisfy many of their every day needs for short term cash,” said Rep. Sewell. “However, there are some bad actors within this industry that operate outside of the law.  These actions must quickly be addressed by the Consumer Financial Protection Bureau. Ultimately, this industry must do a better job of educating and providing more transparency about the products and services that they offer.  It is my hope that the CFPB will create and implement a balanced approach to its regulation of these non bank service providers while punishing the bad actors that only seek to take advantage of our consumers.”

Dear banks, make your disclosures more clear, Date says

Raj Date, the acting head of the Consumer Financial Protection Bureau (CFPB), weighed in on the BofA $5 debit card fee controversy for the first time yesterday, according to an LA Times blogpost. Though he did not directly mention Bank of America’s new $5 monthly debit-card fee, Date said that banks often are murky about how much they charge customers and suggested the agency might move to simplify checking account disclosures.

“Different banks charge different fees. Different fees are applied under different terms and conditions. Different banks give different names to the very same fee,” Date said. “Ideally, consumers would have a simple way to evaluate checking account costs.”
