Bank of America is worried about its reputation, so it wants to play nice with Congress.  From the WSJ article:

{BOA Chief Executive} Moynihan, who joined a Bank of America predecessor as a lawyer, has promised to quicken the pace of mortgage modifications, pitched ideas for stimulating small-business activity, hinted that Bank of America won’t oppose a proposed consumer-protection agency and fretted about how President Barack Obama would define the proprietary trading he wants to curb at giant banks, according to people familiar with the CEO’s comments.

Most banks, to their credit, are opposing the agency and making their voices heard on Capitol Hill
